The Madurai Bench of the Madras High Court on Friday said that the Nirmala Devi audio tape case cannot be shifted from the CB-CID to CBI. The All India Democratic Women’s Association (AIDWA) had filed a petition seeking a direction to transfer the investigation in the Nirmala Devi audio tape case from the CB-CID to CBI.
A Division Bench of Justice M. Sathyanarayanan and B. Pugalendhi who heard the petition said that the CB-CID, which investigated the case, has made the charge sheet and the case is at its final stage.
Therefore, the high court need not interfere in the case which is at its final stage. Moreover, the trial court has the powers to add more criminals. Therefore, we are dismissing this petition and also lift the injunction imposed on the lower court to try the case.
